SHIPPING POLICY — WHOLESALE / B2B

This policy applies to wholesale orders sold by Electronic Cigarettes, INC. d/b/a HempWholesaler.com (“Seller”) and is incorporated into our Terms of Service.

1. PENNSYLVANIA SELLER AND FULFILLMENT

Seller is a Pennsylvania limited liability company with its principal place of business and primary warehouse at 1 Alberigi Drive, Suite 112, Jessup, PA 18434. Each order is reviewed and accepted in Jessup, Pennsylvania, and each sales contract is formed in Pennsylvania.

Stocked orders ordinarily are picked, packed, and shipped from our Jessup warehouse. Select items may be tendered by an approved manufacturer, service provider, or fulfillment facility. A different shipping origin does not change the contracting Seller, Pennsylvania place of contract formation, governing law, forum, or Buyer’s destination-law responsibility.

2. PROCESSING AND TRANSIT ESTIMATES

Our regular warehouse hours are Monday through Friday, 9:00 a.m.–5:00 p.m. Eastern Time, excluding holidays. We prioritize orders received before 1:00 p.m. Eastern for same-business-day processing, but same-day shipment is not promised. Allow 1–3 business days for ordinary processing and longer during high-volume periods, account review, payment review, weather, or regulatory screening.

Domestic transit commonly takes 2–7 business days and international transit commonly takes 7–14 days, but all pickup, processing, customs, and delivery dates are estimates. Seller is not responsible for delay caused by a carrier, customs authority, weather, labor interruption, inaccurate address, governmental action, legal change, or event outside Seller’s reasonable control.

3. FREE-SHIPPING PROMOTION

When displayed at checkout, free standard shipping applies to eligible wholesale merchandise orders of at least $450 shipped within the contiguous United States. Alaska, Hawaii, Puerto Rico, other U.S. territories, international destinations, oversized freight, special handling, and other stated exclusions do not qualify. Seller may change or end a promotion prospectively.

4. DESTINATION ELIGIBILITY — NO LEGALITY WARRANTY OR GUARANTEE

SELLER DOES NOT REPRESENT, WARRANT, OR GUARANTEE THAT A PRODUCT MAY LAWFULLY BE SHIPPED TO, ENTER, BE DELIVERED TO, RECEIVED, POSSESSED, MARKETED, RESOLD, DISTRIBUTED, OR USED AT THE DESTINATION.

Buyer alone must investigate the law applicable to the exact product and destination, obtain independent legal advice, and maintain all licenses, permits, testing, labeling, tax, age-verification, and resale controls. Seller’s acceptance, screening, packing, shipment, delivery, or decision not to block an address is not legal advice, governmental approval, or a compliance determination. Shipping restrictions are non-exhaustive commercial controls and do not transfer Buyer’s responsibility.

Seller may hold, reject, or cancel an order for any destination or product. After carrier tender, Buyer bears the risk of regulatory detention, refusal, seizure, confiscation, destruction, or return. Those events do not create a right to a refund, credit, replacement, or chargeback.

5. SHIPMENT CONTRACT; TITLE AND RISK OF LOSS

Unless an authorized Seller officer signs a different delivery term, each sale is a shipment contract, F.O.B. the applicable shipping origin. Title and risk of loss pass to Buyer when the goods are duly tendered to the carrier, subject to Seller’s security interest. Seller may select the carrier and service level unless the accepted order states otherwise.

6. ADDRESS, DELIVERY, LOSS, AND THEFT

Buyer must provide a complete accurate address and a secure recipient. Address changes are not assured after order submission. Buyer is responsible for carrier charges, return freight, and a 15% restocking fee for refused or undeliverable packages, incorrect addresses, failed signature or pickup, or other Buyer-caused return; original freight is nonrefundable.

Seller is not responsible for a package the carrier marks delivered that is later missing or stolen. For a package lost in transit, Seller may assist with a carrier claim, but that assistance does not restore risk of loss or promise a carrier payment. Buyer must preserve tracking records and cooperate with the carrier.

7. HEAT-SENSITIVE GOODS

Gummies, chocolates, and other heat-sensitive goods may melt or change during transit. Buyer should select expedited service and arrange immediate receipt during warm weather. Seller does not provide a refund or replacement for temperature-related damage after carrier tender unless Seller expressly agrees in writing.

8. INTERNATIONAL SHIPMENTS

Buyer must arrange an appropriate customs broker before shipment when requested. Unless Seller expressly agrees otherwise in a signed writing, Buyer is the importer of record and is solely responsible for import eligibility, brokers, permits, declarations, product registration, duties, taxes, customs clearance, and regulatory action. Customs delay, refusal, or seizure is Buyer’s risk.

9. SHIPPING CLAIMS

Inspect the shipment immediately. Written claims for visible damage, shortage, wrong item, or other apparent nonconformity must reach info@hempwholesaler.com within 72 hours after the carrier’s delivery timestamp. Include the order number, SKU, lot if available, quantity, detailed description, and clear photographs of the goods, seals, shipping label, carton, and packing material. Preserve all goods and packaging for inspection. Untimely or incomplete claims may be denied.

10. RETURNS AND REMEDIES

Do not return goods without written authorization. Return eligibility, nonreturnable goods, latent-defect notice, and the sole and exclusive remedies are governed by our Refund Policy and Terms of Service. If the documents conflict, the order of precedence in the Terms of Service controls.
